Terms and Conditions
These Terms and Conditions ("Terms") govern your use of Diablo VPN (the "Service") provided by Diablo VPN ("we", "our", or "us"). By creating an account or using the Service you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By using the Service you represent that you have the legal capacity to enter into this agreement.
2. Account Registration
- You must provide accurate and current information when creating an account.
- You are responsible for maintaining the confidentiality of your credentials.
- You are responsible for all activity that occurs under your account.
- You must notify us immediately of any unauthorised use of your account.
3. Subscriptions & Payments
Access to premium features requires an active subscription. Subscriptions renew automatically for the period selected at purchase unless cancelled before the renewal date. Pricing, billing cycles, and plan features are displayed inside the application at the time of purchase.
All payments are non-refundable except where required by applicable law. If a payment fails we may suspend access to premium features until payment is received.
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law, regulation, or third-party right.
- Send spam, phishing, malware, or other malicious traffic.
- Attempt to gain unauthorised access to any system, network, or account.
- Distribute or transmit content that is illegal, infringing, or harmful to minors.
- Resell, sublicense, or transfer the Service without our written permission.
- Interfere with the operation of the Service or with other users' enjoyment of it.
- Run open-relay, proxy, or other services for third-party traffic over the VPN.
5. Service Availability
We strive to keep the Service available at all times but do not guarantee uninterrupted or error-free operation. We may suspend the Service for maintenance, upgrades, security, or capacity reasons.
6. Intellectual Property
The Service, including all software, branding, and content provided by us, is owned by Diablo VPN or its licensors and is protected by copyright and other intellectual-property laws. We grant you a personal, non-transferable, non-exclusive, revocable licence to use the Service for its intended purpose.
7. Suspension & Termination
We may suspend or terminate your account if you breach these Terms, abuse the Service, fail to pay any amount due, or if required by law. You may close your account at any time from within the application or by contacting us.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.
9. Limitation of Liability
To the maximum extent permitted by law, Diablo VPN and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total aggregate liability for any claim relating to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
10. Indemnity
You agree to indemnify and hold us harmless from any claims, liabilities, damages, losses, and expenses arising from your use of the Service or your breach of these Terms.
11. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on this page and take effect when posted. Continued use of the Service after changes constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of the jurisdiction in which Diablo VPN operates, without regard to its conflict-of-laws provisions. Any disputes arising under these Terms shall be resolved in the courts of that jurisdiction.
